THE LAW RELATING TO THE REMOVAL OF TESTAMENTARY EXECUTORS AND TRUSTEES IN QUEBEC

Abstract

In this article the author examines the subject of testamentary executors and trustees and specifically looks at the law relating to the subject in Quebec. First, the author examines Quebec’s Civil Code relating to testamentary executors, and then takes a closer look at the grounds for removing a testamentary executor under the Quebec Civil Code. Next, the author examines the law of Quebec relating to trusts, as well as the law of England, and points out the similarities and differences between the two. In concluding his article, the author looks briefly at the Canadian law of trusts outside of Quebec law, as well as the American law of trusts, and determines how they compare to the law of England.
