Abstract

In this article the author discusses some of the questions surrounding instances where a stranger to an obligation attempts to secure the discharge of an obligor. In particular, the author discusses the situations where a stranger attempts to satisfy an obligation by means of an accord and satisfaction. The author thoroughly examines the case law surrounding the subject, including both English and American jurisprudence. In examining such authorities the author then draws his own conclusions as to when a stranger can discharge another’s obligation.
