Abstract

In a previous contribution published in volume 86 (at pages 39 to 67), we have begun to summarily describe the Canadian patent law system, in the hope that a succinct overview of the present state of the law will be of use to the ordinary jurist and, possibly, to the general public. In the first part, we presented the normative sources of the relevant Canadian legal regime and succinctly explained what can be patented and the conditions of patentability. This second part will deal with the scope and limits of exclusive rights, the procedure to obtain patent protection and the duration of the legal protection.
