Abstract

This article provides a description and critical analysis of the constitutional amending formula proposed by the Fulton and Favreau Bills for Canadian constitutional amendment. The author first outlines the history of the proposed amending formula, detailing the events leading to the Fulton and Favreau Bills. The author then provides a critical analysis of the proposal, projecting that the amending formula will prove to be unworkable. Accordingly, the author provides alternatives to the proposed amending formula, advocating a change in emphasis and new approach.
