Abstract

This article details how subdivision, the system of private land ownership, is administered in the Canadian context. The author does so through an examination of the nature of the control of this process of division exercised by various Canadian provinces and municipalities. The author first provides an examination of the need for control of this process, highlighting the problems faced by historical planning and its modern objectives. The article proceeds with a survey of where control lies in each of the provinces, and details guides to the exercise of that control in the form of by-laws and manuals. Finally, the author explores the role of the federal government in the subdivision process in the form of the central mortgage and housing corporation, concluding with a survey of the power to refuse tenders and the ramifications of ignoring such a refusal.
