FALCONBRIDGE'S CONTRIBUTION TO THE CONFLICT OF LAWS

Abstract

This article describes Falconbridge's contributions to with respect to conflict of laws, especially the principles of renvoi. After describing the problems and issues associated with the doctrine, it reviews Falconbridge’s general views on renvoi as expressed in his various articles. The issue of characterization is approached in the same manner, with a review of the problems and issues, and of Falconbridge’s unique method of provisional characterization. Finally, the author surveys Falconbridge’s contributions to the redrafting of the Lord Kingsdown’s Act as secretary of the Conference of Commissioners on Uniformity of Legislation in Canada, and the content of his essays on conflict of laws.
