Abstract

It may be obscure, nonsensical, incoherent and ugly, but the law of licence is today the most fertile, and certainly the most discussed, single field of legal activity. Mired by conflicting terminologies in the shadowland between contract and real property, the licence suffers from the chronic legal affliction of overloading concepts with hieroglyphic associations. Samuel Stoljar unpacks this legacy of impossible principles in an attempt to eliminate some famous difficulties and to propound a more rational explanation of the licence.
