Abstract

The author uses the doctrine of substantial performance as the basis for discussion, and therefore traces its evolution and explains its ingredients and implications. The doctrine is compared to contrasting results based on the complicated machinery of conditions in the sales of goods context. Finally, the discussion is concluded with consideration of the applicability of the doctrine of substantial performance to the second category of sales of goods: sales by description.
