Abstract

This article examines the link between legal rights and interests. The author claims that an understanding of licences will shed some light on the definition of an interest, but this entails surveying the recent changes to the licence concept in English courts, particularly the judicial statement that a licence conveys a right in rem. He considers the recent history of occupational licences in English courts, attempting to determine how they differ from leases. He also considers how that history and the concept of the legal interest is affected by the spousal right of consortium.
