THE ADMINISTRATIVE COURTS IN FRANCE

Authors

  • BERNARD SCHWARTZ

Abstract

The author believes that an objective appraisal of the French system of droit administratif will give to the Anglo-American system the foundation for proper judgment on the value of proposals to create administrative courts in the common-law world. In order to conduct this appraisal, he first explains the working of the French administrative courts, their organization, jurisdiction and manner of proceeding. He then attempts to analyze the substantive details of the droit administratif.
