CONVICTION AND PROBATION INTRODUCTORY NOTE

Abstract

In this article the authors introduce England’s Probation Act, as well as the Criminal Justice Bill, and discuss the importance of their role in England’s administration of criminal justice. In doing so, the authors discuss the effect that the Criminal Justice Bill had had on the Probation Act, and looks at cases that have supported one over the other. In concluding their article, the authors then suggests that the conflict between the two has yet to be settled, and that the arguments contributing to such conflict must be thoroughly considered before any solution can be reached in England.
