PEACE, ORDER AND GOOD GOVERNMENT
Abstract
In this article the author examines the “peace, order and good government” clause, as well as sections 91 and 92, of the British North America Act. The author discusses the various proposals for providing the Parliament of Canada with the legislative authority that is arguably set out in section 91 of the British North America Act. Next, the author pays particular attention to the proposal made by Senate Counsel, W.F. O’Connor and also examines the views expressed by the Judicial Committee concerning the proper construction of sections 91 and 92. The author then turns to the O’Connor report and examines its reasoning, and concludes his article by discussing relevant material not included in the report.Keywords:
