Abstract

Enacted in 1979, the Act Respecting the Collection of Certain Debts is a law of public order whose application is inadequate. This law is not always enforced by the courts, or even respected. Moreover, its violation is sometimes excused or timidly sanctioned by the courts. Jurisprudence shows that the courts are extremely deferential as to the practices of institutional creditors and collection agencies.
