Abstract

The case of Richard v Time Inc was the first time that the Supreme Court made a detailed examination of the appraisal parameters that should guide a Quebec judge in establishing the quantum of punitive damages. Although the author agrees with the final outcome and with a number of the clarifications made in this case, he finds that the comprehension of some of those parameters does not seem to match the intention of the legislature and the coherence of Quebec civil law.
