Abstract

The calculation of attorney fees in the realm of class actions is based on either the percentage of recovery or on a risk multiplier. The method used to assess the services rendered by plaintiff counsel is often approached mathematically. However, attorney fees have always been based, both historically and legislatively, on the rules of professional ethics. This article proposes an ethical approach to the determination of attorney fees, and encourages practitioners to harmonize percentages with principles, quantity with quality.
