Abstract

The subject of domicil presents for consideration local problems arising out of our constitution and method of government. Some matters of law that are determined by the test of domicil are capacity to contract, jurisdiction to dissolve a marriage, validity and construction of marriage settlements, succession to movables of a deceased person, legitimacy, and the validity of an assignment of death. Many attempts have been made to define domicil but none have succeeded. There are at present two schools of thought on the subject: the English and the (European) Continental. The difference lies in the acceptance of domicil or nationality as the factor for deciding the personal law relating an individual.
