THE CANADA-UNITED STATES ANTITRUST NOTIFICATION AND CONSULTATION PROCEDURE A STUDY IN BILATERAL CONFLICT RESOLUTION

Abstract

The author believes there is an urgent need to develop models of bilateral dispute resolution systems to aid in the recognition and solution of interstate conflicts at an early stage. He uses the situation of economic interdependence between Canada and the United States, in particular the Antitrust Notification and Consultation Procedure, to determine whether current potash and uranium disputes between Canada and the United States illustrate a mode of bilateral dispute settlement suffering from either a technical design defect, a failure of good will, or a basic misperception of national policies or perceptions.
