Abstract

The purpose of this article is to determine whether there is a need for reform regarding the law governing infants’ contracts. It reviews several categories of contracts including contracts for necessaries and services, voidable contracts and those that remain binding until repudiated, including contracts concerning land, share contracts, partnership agreements and marriage settlements. It examines the requirements and effects of repudiation, those contracts not binding until ratified, void contracts, liability for torts connected with the performance of a contract, the effect of agency and secured performance through the introduction of a third party. The author urges reform to clarify the uncertainty in the areas canvassed.
