Abstract

Given the growing concern over alien land ownership in Canada, this article attempts to determine the competence of governments to forbid aliens and non-residents from holding land in a province and prevent Crown grants of public lands to aliens. It surveys the legal aspects of the issue from three perspectives: the historical background, current federal and provincial conditions and constitutional issues involved in changing the current law. It then examines federal and provincial legislation related to Crown land grants to determine its validity and the constitutional position of restrictions on Crown grants to aliens.
