CIVIL RIGHTS IN EXPROPRIATION

Abstract

In this article the author examines the procedural aspects of expropriation within Canada. First, the author defines the word “expropriation” and discusses whether or not compensation should be considered a civil right. Through a thorough examination of the recommendations found in the McRuer Report, the author then determines what an entrenched constitutional provision relating to expropriation should entail and in doing so, takes a closer look at the current expropriation laws within Canada. In concluding his article, the author argues that the recommendations of the McRuer Report are most helpful and thus, the government of Canada would be wise to follow them closely.
