Abstract

Some have called it inconsistent. Others have ridiculed it for its archaisms. It has been disparaged for its verbosities and mocked for its ambiguities. But this object of derision has, nonetheless, been in force since 1893; and despite its stubborn recidivism and a litany of charges against it, no one has sentenced it to death. Close at its side are all the powers designed to curb and reform the guilty mind, yet now the powers of reform are turned against it for, on 1 April 1955, the revised Criminal Code of Canada will come into force. What is the primary purpose of the revision? A.J. MacLeod and J.C. Martin take us through the new Code, from legislative history to enactment, and conclude that its coming into force does not mean that the work of criminal code revision is at an end.
