CONVICTION AND PROBATION THE CASE AGAINST CONVICTION

Abstract

In this article the author briefly discusses some of the motivations behind desires to reform England’s Probation Act. In doing so, the author examines the history leading up to the Criminal Justice Bill. In concluding his article, he then comments on how the Probation Act has served its purpose remarkably well, and argues that any defects in England’s probation system can be attributed to the courts’ failure to use the Act as the law and statutory regulations permit.
