SOME REFLECTIONS ON OWNERSHIP IN ENGLISH LAW

Abstract

This article looks at the meaning of ownership within English law. First, the author looks at a comprehensive definition of ownership and its shortcomings. He then looks at the shortcomings of a less comprehensive but more common meaning whereby the ownership of both corporeal and incorporeal things is included. In an attempt to give the meaning more clarity, the author then goes through the history of the meaning of ownership within the law of England. He concludes that the conception of ownership over different kinds of property is a relative matter and closes the article by setting out his own approach to discovering the meaning of ownership.
