Abstract

This paper offers a reflection on the institutional culture of the Supreme Court. In 1875, the Court's culture reflected the image of a dynamic and unified society, surmounted by a strong and minimalist legal order. The social transformations produced by the passage to modernity would justify today the alternative vision of a risk society, highly fragmented and penetrated by a ubiquitous but weak Rule of Law. The first institutional challenge for the Supreme Court in. the 21St Century would be to promote a legal policy treating differentially the respective aspirations of human beings and corporate persons to liberty .
