Abstract

It has been thought that society in its legal evolution has been moving from status to contract. This generalization is not necessarily true for our age. There are strong currents in modern social evolution which have brought about legal situations that cannot be subordinated in any way to notions of free agreement and further, call for a revision of the view that the law of status has ceded it’s place to voluntary agreements. However, by looking back at the historical process it is fair to say that status may be winning back some of its importance.
