REPENSER L’ADMINISTRATION DE LA PREUVE PAR EXPERTISE EN DROIT DISCIPLINAIRE
Abstract
Certain difficulties relating to the management of expert evidence are common to both judicial tribunals and disciplinary proceedings. The article provides a comparative perspective on expertise between civil and disciplinary proceedings in Quebec, making it possible to identify key distinctions between experts’ roles in each of these proceedings. This comparison will shed light on the functions of expertise in the disciplinary field, to better understand the role of the parties involved. Finally, the article will present some recent trends in the use of expert evidence in civil matters and assess whether these can be transposed to disciplinary matters.
