THE HISTORY OF THE CRIMINAL INFORMATION

Abstract

The two most important methods of beginning a criminal prosecution have been the procedure by way of Presentment and Indictment, and the procedure by way of Criminal Information. In the developed common law there are many kinds of informations. For example there is the criminal information brought by a subject on a penal statue on behalf of himself and the Crown and that brought solely by the King. The history of the information has been colored by political and constitutional influences coming from different periods in our history of law. The medieval to seventeenth century are discussed.
