Abstract

The contribution that the Hon. Louis LeBel made to the field of labour law in the transition from the Fordist era to the new economy is undeniable. Through his very tangible teachings, he contributed in various ways to its evolution and transformation. In concrete terms, he had a great influence on the handling of labour relations matters by the actors in that community and on the role of the grievance arbitrator in disputes about such matters. This paper looks at the holdings of Justice LeBel from three angles: (1) the subject-matter jurisdiction of the grievance arbitrator and the latter’s renewed role; (2) the interpretation of laws of public order and the order of precedence of the standards; and (3) managerial rights with regard to suspension.
