Abstract

In 1994, the law governing real security and the publicity of rights underwent a major reform, especially in the area of movable security interests. It would now be appropriate to consider whether some of the fundamental choices made by the legislator at the time were wise. For that purpose, we decided to verify the accuracy of the legislative policies on which the legislator relied in 1994 by comparing them to the major trends now propounded in that area. In that respect, the UNCITRAL Legislative Guide on Secured Transactions, drafted by the United Nations Commission on International Trade Law (UNCITRAL) and adopted in December 2007, will be of great help.
