L'APPLICATION UNIFORME DE LA CONVENTION DE VIENNE SUR LA VENTE INTERNATIONALE DE MARCHANDISES
Abstract
International sale of goods represents the pivotal contract of transborder trade. The Vienna Convention's goal is to achieve substantive uniformity in the law, so as to remove the juridical uncertainty resulting from the application of domestic laws that are less suitable to govern international trade. However, the Convention's interpreters must change their judicial philosophy that requires them to change the way they think and make law. This article attempts to better define the interpretation guidelines of the Vienna Convention on international sale of goods and at the same time to delve into the role of doctrine and jurisprudence in this process.Keywords:
