ENTRE LA DEREGLEMENTATION ET LA SURREGLEMENTATION: LE DROIT QUEBECOIS DE L'ENVIRONNEMENT

Abstract

The Quebec Ministry of Environment has committed itself to accomplishing an extensive revision and improvement process and reduction of its governmental directives. The Ministry intends to examine in depth its functioning methods with the intention to replace its many regulations by environmental protection strategies founded on economical tools all the while basing this effort on a continuous negotiation with the enterprises that have become management partners. However, this regulation reduction and improvement operation is occurring in a context of over regulation where a multitude of norms overlap without much convergence. Two regulatory reforms have been realized in 1997-1998 in nerve center sectors of environmental law: agricultural pollution and hazardous waste disposal and management thereby providing a renewed negotiation framework for the establishment of these partnerships between the various industries and the regional directors of the Environmental Ministry.
