Abstract

Professionals who are found guilty of having committed a crime will usually also be disciplined by their professional body. They may be even sued civilly if their actions give rise to civil liability. The author of this article examines the extent to which it is possible to use before a second tribunal evidence tendered in an earlier proceeding. The author also discusses some other questions connected with disciplinary proceedings. In so doing he considers the immunity of a plaintiff in Quebec, the confidentiality of information gathered in the course of disciplinary proceedings and the privilege against self-incrimination.
