Abstract

The author states that expecting answers to the many complex legal questions about the law of interprovincial rivers is impractical because too few cases in the area have been decided. Rather, the purpose of this article is to expose the questions. To that end, the focus areas are divided into boundary rivers and transboundary rivers. The major question under boundary rivers involves how to locate the boundary. Transboundary rivers raise two principal issues: the applicable law and the appropriate court in which to hear related matters. Both issues are considered according to common law, statutory authority and federal jurisdiction.
