THE INTRODUCTION OF THE TRUST IN LOUISIANA

Abstract

Historically, the American State of Louisiana took one of the strongest positions of antagonism to the common law trust. In 1938 however, Louisiana adopted the common law trust by means of the Louisiana Trust Estates Act. In this article the author briefly examines the historical background of the Act, as well as some of its more significant operational aspects. In doing so, he illustrates that although changes to the Act will undoubtedly come about in the near future, on the whole the trust has been successfully established in Louisiana law.
