TRUSTS AND POWERS
AbstractThe purpose of this article is to consider the distinctions between trusts and powers from the stance of mode of creation, enforceability, certainty and delegation. Believing the traditional terminology used to discuss the division of powers of appointment into special and general powers to be inadequate, the author analyses and employs a previously suggested division into limited and unlimited powers, and proceeds to set forth and elaborate on the above distinctions.
