Abstract

Along with the expansion of business conducted in the corporate form, the problem of corporate reorganization has also grown in Canada. As a result, serious attention has been given to providing a cure, by way of reorganization, for failing businesses. This article concerns the general features of bond issues that have some bearing on reorganization procedures and attempts an overview of the basic issues. Discussion is restricted to the situation of a typical first mortgage bond issue secured in accordance with Ontario law by both fixed and floating charges on an industrial business. The author examines the rights and remedies of bondholders as mutually interlocked.
