CRIMINAL CONTEMPT OF COURT PROCEDURE: A PROTECTION TO THE RIGHTS OF THE INDIVIDUAL

Abstract

Criminal contempt of court can be divided into three kinds: contempt committed in the face of the court; comments on cases pending in the courts; and scandalizing the court by the publication of scandalous matter of the court itself. The author discusses the third category under five headings: 1) contempt by publication of evidence or comments before the case is heard; 2) publication of comments during the trial; 3) publication of comments after the trial but before an appeal is heard; 4) criticism of the administration of justice; 5) responsibility for contempt; and 6) the right of appeal.
