Abstract

Because questions regarding liability for spreading false information are regaining importance, the author suggests that the legal rules limiting freedom of communication require re-examination to see whether there should be higher legal standards than have prevailed in the past. In order to do so, he examines section 136 of the Criminal Code, including its history and the present law in Canada regarding public mischief through spreading false news.
