Abstract

Article 1301 of the Quebec Civil Code contains a prohibition against a wife purporting to enter into obligations except in common with her husband. Claiming that the principle laid down is a radical departure from the previously existing law, the author undertakes an historical and juridical analysis of the article, examining its adequacy under the current conditions of contemporary society.
