WHAT CAN LAWYERS SAY IN PUBLIC?
Abstract
Lawyers increasingly appear in the media to discuss their clients' cases. Such public appearances are governed by a complex set of rules, both ethical and legal. The first part of this article examines the provincial rules of professional conduct which regulate public statements made by lawyers. The article then proceeds to examine those aspects of the law of defamation, contempt and fiduciary duty which form the legal framework for assessing the propriety of any public statement made by a lawyer during various stages of a lawsuit.Keywords:
