PLAIDOYER POUR UN OUVRAGE APPROFONDI EN DROIT DES BIENS
AbstractGiven the central place of the law of property in private law, and its real and metaphorical importance to our community, the author argues that an analysis of Civil law property and its underlying philosophy is required. He postulates the need for an all-encompassing text in Civil law property, a text which examines not only Book Four of the Civil Code of Quebec but also the role of property in the Civil law generally and in Quebec society. This article examines some of the constituent elements of such a text, notably the examination of the law as contained within and withoutthe Civil Code, and the situating of property law in its economic, social and political context.
