A CASE FOR SOCIAL LAW REFORM
Abstract
The author advocates a new approach to law reform, called social law reform. By contrasting this new approach with the traditional legal approach to law reform, he sets out deficiencies in the traditional approach, particularly with regards to legislation. The contrast illustrates the new approach’s ability to consider “real world” issues in the law reform process rather than remaining restricted by traditional confines of legal thought and projections from the profession. Professor Noel Lyon’s Law Reform Needs Reform is used to underscore his own ideas and argue for a dialectical approach to the overriding question of how to achieve such reform.Keywords:
