Abstract

In contrast to constitutional form, the constitutional spirit is defined as the instinct for justice, liberty, practical balancing of rights with duties, and powers with safeguards and the Christian instinct that recognizes the supreme position of the individual. The author speaks of each instinct and, after illustrating the forces that threaten it, shows how the spirit of the constitution prevails to accord justice.
