Abstract

In this article the author examines the Report issued by the Law Revision Committee in London and its recommendations in respect of the doctrine of consideration and contracts for the benefit of third parties. First, the author looks at the Committee’s criticisms of the present state of the law of England in relation to those areas. The author next examines several civil law systems that do not recognize the doctrine of consideration including the Austrian Civil Code, the Civil Code of Quebec, and the German Civil Code. He then thoroughly examines the recommendations put forth by the Committee concerning the doctrine of consideration and contracts for the benefit of third parties, and concludes that although valuable, introducing such recommendations into the Common Law may prove to be difficult.
