THE FUTURE OF THE LAW OF OUTER SPACE

Abstract

Despite the advent and continuing evolution of space law, the international law field dealing with outer space remains virtually undeveloped. This article discusses the potential legal problems that may accompany the development of outer space. In doing so it refers to the main questions raised by the legal section of the Report of the Ad Hoc Committee and in particular, focuses on problems existing with respect to determining liability for injury or damage caused by space vehicles. It then discusses possible solutions with regard to the responsibility for such injury or damage, as well as briefly examines the question as to what procedure would be taken in bringing action against governments. The author concludes by pointing out that the development of outer space presents a big challenge that lawyers must be prepared to embrace.
