PROCEDURE UNDER THE NEW CRIMINAL CODE

Abstract

Those who dared transgress the Commandments were doubtless in for more than a blast caught from the hand of Moses as it passed over Sinai’s top. Indeed, if procedural safeguards did exist to protect the rights of the accused, they are difficult to find in the biblical record. But nowadays, rules of procedure ensure that criminal justice is swift and sure. A.J. MacLeod and J.C. Martin survey a number of changes to procedural matters in the new Criminal Code. Since Parliament’s omissions are sometimes as significant as its commissions, the authors invite us to cast an eye upon the procedural recommendations of the Royal Commission that were adopted by Parliament, and those it refused to sanction.
