THE GROWING AMBIT OF THE COMMON LAW

Abstract

Continued from a previous issue, the author considers the fusion of law and equity on jurisprudential levels over the past seventy years. As the changes are most obvious in the law of contract, he canvasses attempts to unify the law of misrepresentation and mistake and to qualify the strictness of the doctrine of consideration. He examines the corollary strictness in interpretation of exemption clauses.
