Abstract

In this article the author briefly discusses the United States approach to probation and conviction. First, the author discusses the two exceptional instances where conviction will not be a prerequisite to probation in the United States. He then looks at the merits of ordering probation without conviction. H concludes that probation without conviction is merely a legal fiction and thus it need not be of great concern.
