Abstract

This paper provides judges, lawyers, judicial policy makers, and other members of the legal community with an opportunity to evaluate the place of Judicial Dispute Resolution or JDR in Canada's justice system. The authors ask whether judges acting as judicial mediators and undertaking other JDR activities fit within our understanding of the modern judicial function. This question is explored from policy, legal and pragmatic perspectives.
