RECENT DEVELOPMENTS IN AMERICAN ADMINISTRATIVE LAW

Abstract

This article surveys important developments occurring in American administrative law since 1972. Regarding administrative powers it surveys the expansion into non-regulatory mass administration, broad delegations of power, introduction of the legislative veto and amendments to the Freedom of Information Act. Regarding administrative procedures, the Courts have abandoned the line of cases requiring stricter rule-making than required by governing legislation, expanded the right to evidentiary hearings and transformed hearing officers into an administrative judiciary. The article surveys the increased availability and scope of judicial review, and the imposition of limits to state immunity.
